Recently, China Rubber Magazine reported that the General Court of the European Union made a first-instance ruling: the European Commission’s anti-dumping and countervailing duty orders against China’s truck and bus tires should be revoked, and the European Commission and its supporting parties should bear the litigation costs.

This judgment means that if the European Commission does not appeal within two months, the double anti-duty paid by the Chinese tire company suing will be refunded in full!

It is understood that on November 12, 2018, the European Commission officially announced the final ruling of the EU's anti-subsidy case against China truck and bus tires. In the following five years, Chinese tire companies will need to pay 42.73~61.76 yuan for each truck and bus tire exported to the EU. Fixed tax in Euros (333.7~482.3 RMB).

EU countries are important export areas for China's truck and bus tires. According to Eurostat data released by the European mLex website, from 2013 to 2016, the average price of tires from China dropped from 2,820 euros/ton to 2,200 euros/ton, while the import volume was almost doubled.

However, this tariff has seriously hindered the export of Chinese truck and bus tires to the EU, damaged the interests of Chinese tire companies, and once greatly reduced the number of Chinese truck and bus tires exported to the EU.

In this regard, Chinese tire companies and China Rubber Association actively negotiated and searched for evidence, and found that there were many legal errors in the final ruling of "double-anti".

On January 15 and February 6, 2019, China Rubber Association, on behalf of the enterprise, submitted an anti-dumping final indictment and a countervailing final indictment to the EU General Court respectively.

After several rounds of confrontation, on May 4, 2022, the General Court of the European Union announced the first-instance ruling, which supported the core proposition of the China Rubber Association and rejected the European Commission's wrong approach, and rejected the European Commission's request for partial revocation of the tax order.

The final judgment completely revokes the European Commission's "double-reverse" tax order on China truck and bus tires, and the effect of the revocation covers the company that filed the lawsuit.

 

This victory is also a major positive for tire companies that are currently in trouble due to the impact of the epidemic! Chinese truck and bus tires will return to the European market, which is conducive to the further expansion of the export market of Chinese tire companies!
